Terms and Conditions for the Human Kind Summit
Introduction
These terms and conditions govern the purchase and use of tickets for the Human Kind Summit ("Event"), which will take place between 16 March 2023 and 18 March 2023 at Luna Park, in Sydney, NSW, Australia. The Event is organised and operated by Andoo Pty Limited (referred to as "we", “our” or "us"). The tickets for the Event will be sold through a third-party vendor, Humanitix Ltd (ABN: 32 618 780 439) (“Humanitix”). These terms apply in addition to any separate Humanitix terms and conditions in respect of the Event.
Ticket Sales
2.1 When purchasing a ticket, you will be required to provide personal information, including your name, email address, and contact details. By providing your personal information, you agree to all terms and conditions set out in our Privacy Policy. We take steps to ensure the privacy and protection of your personal data.
2.2 Tickets are non-transferable and non-refundable, except as provided in these terms and conditions.
2.3 If you are unable to attend the Event due to personal circumstances, you may transfer your ticket to another person, provided that you notify us of the transfer and provide us with the new ticket holder's details and they agree to the terms of conditions.
Event Cancellation and Changes
3.1 We may cancel, postpone or vary the Event at our absolute discretion. In the event that the Event is cancelled, postponed or significantly varied, we will:

use our best endeavours to inform ticket holders; and
-
offer ticket holders a comparable ticket to a postponed or significantly varied event or refund the ticket for the cancelled Event.
3.3 In the event of a talent or participant cancellation, we will not be liable for any expenses incurred by ticket holders, such as travel and accommodation.
Liability
4.1 We will not be liable for any loss or damage suffered by ticket holders in respect of the Event, including, as a result of:
-
attending the Event;
(b) cancellation, change of date, or change of location of the Event;
(c) talent or participant cancellation; or
(d) inclement weather.
4.4 Governing Law
These terms and conditions are governed by the laws of New South Wales, Australia.
Weather and Safety
6.1 The Event will take place rain, hail or shine. In the event of extreme weather conditions that pose a safety risk to attendees, we reserve the right to cancel or postpone the Event.
6.2 Attendees are responsible for their own safety while at the Event and should take appropriate precautions to protect themselves and their belongings. We will not be liable for any loss or damage suffered by attendees as a result of their own actions or failure to take appropriate precautions.
Security
7.1 We will take appropriate measures to help ensure the security and safety of attendees at the Event, however, we will not be liable for any loss or damage suffered by attendees as a result of criminal activity or activities outside our control.
7.2 Attendees are responsible for complying with all security measures in place at the Event, including but not limited to bag checks and pat-downs.
Accessibility
8.1 We will take reasonable steps to ensure that the Event is accessible to attendees with disabilities, however, we cannot guarantee that all areas of the Event will be fully accessible.
8.2 Attendees with disabilities should contact us in advance to discuss any specific needs or requirements.
Refund Policy
9.1 Tickets are non-refundable, except in the case of Event cancellation or change of date/location as outlined in section 3.
9.2 Any approved refunds will be processed within 30 days of the Event being cancelled or the new date/location being announced.
Limitation of Liability
10.1 To the fullest extent permitted by law, we exclude all liability for any claims, loss or damage suffered by attendees as a result of attending the Event, including but not limited to any indirect or consequential loss.
10.2 Our total liability to attendees for any claim arising out of or in connection with the Event will not exceed the ticket price paid by the attendee.
Intellectual Property
11.1 We will own all Intellectual Property Rights in respect of the Event and any associated website created by us including all Intellectual Property Rights worldwide to the software, technology, processes, materials and content on our websites (excluding any pre-existing Intellectual Property rights of a third party).
11.2 You must not use, copy, monitor, modify, transmit, store, extract, reverse engineer, publish or distribute any material on or accessed via our websites without our prior written consent.
11.3 You agree that you will not use in any way, including but not limited to in any publishing or advertising, any of our Intellectual Property, without our prior written consent.
11.4 We may restrict or block your access to and use of our websites at any time if we reasonably believe that you may have breached any provision in these terms.
11.5 ‘Intellectual Property Rights’ means all industrial and intellectual property rights of any kind, including but not limited to copyright (including rights in computer software), trademarks, service marks, designs, patents, trade secrets, semiconductor or circuit layout rights, trade business, domain or company names, rights in confidential information, know-how or other proprietary rights (whether or not any of these are registered and including any application for registration) and all rights or forms of protection of a similar nature or having equivalent or similar effect to any of these which may subsist anywhere in the world.
Refusal of entry or removal from Event
12.1 You must be aged 18 years or over to attend the Event. You must provide us with photographic identification documents being either an Australian driver’s licence, a NSW learner’s permit, a NSW proof of age card or an equivalent from another state or territory of Australia, an Australian or foreign passport, to our satisfaction to verify that you are aged 18 years or over. You may be required to provide photographic identification documents at various times during the Event.
12.2 We reserve the right to, and to authorise or instruct any Event staff to, refuse entry or evict any person from the Event that:

fails to comply with these terms and conditions;

is under the age of 18;

is unable to provide valid and current photo ID that we consider to be sufficient, in our absolute discretion, to prove that the person is aged 18 or over;

engages in any illegal activity or behaviour or any activity or behaviour deemed in our absolute discretion to be unsafe, disorderly or antisocial, including, but not limited to being intoxicated or affected by alcohol or drugs;
-
climbing the staging, rigging or other structures at the Event;

causing damage to property or goods at the Event;

acting in a violent, threatening, inappropriate manner; or
-
for any other reason at our absolute discretion.
By purchasing a ticket for the Human Kind Summit, you agree to be bound by these terms and conditions, together with our Privacy Policy and any separate Humanitix terms and conditions in respect of the Event.
